2024 Proposed CC&Rs
As hopefully you're aware, the Village at Apache Wells is governed by four key legal documents:
- Articles of Incorporation - Defines the formation of the legal entity "Village at Apache Wells" as a non-profit.
- Bylaws - Defines the governing of the business affairs of the association.
- Covenants, Conditions, and Restrictions - Commonly referred to as "CC&Rs", this document is used to manage the use, maintenance and appearance of the association.
- Rules and Regulations - These are specific rules that clarify restrictions identified in the CC&Rs and provide a structured framework to ensure fairness, safety, and consistency in operations.
The third document in that list, our CC&Rs, were last updated in 2006 and in the ensuing 18 years, some of the Arizona laws on which the document was based have changed as well as a few specific terms have become outdated. As such, the Village at Apache Wells Board of Directors have worked over the last year-and-a-half to update the document to conform to current state laws, use current terminology (like "Condo" instead of "Apartment"), and hopefully be a bit more readable.
In order to officially adopt these changes, we need two-thirds of our homeowners to approve the changes.
Our plan is to make the original and modified documents available for the next few months to give everyone the opportunity to review the changes before voting on them. I have created the following 4 documents for your review:
- CC&Rs-Notes on Updates - This is a two-page document outlining the proposed changes
- CC&Rs-Redline-2024 - This is a marked-up original where every change to the document (except formatting) is highlighted in red
- CC&Rs-Final-2024 - This is the proposed final document which is identical to the one above except the changes have all been incorporated into the document
- CC&Rs-Original-2006 - This is a scanned copy of the 2006 revision that was legally filed with the State of Arizona.
Please keep in mind that none of the proposed changes will increase any member's personal liability or responsibility regarding home ownership in the Village.
We plan to send out further instructions in the next few months regarding your opportunity to vote on these changes. We also plan to have printed copies of the above documents available for review in the Clubhouse in the near future.
