oh, well it never hurts to try and ask. oh, and there is such a thing as representing yourself, or another person can chose for you to reresent them and no you dont have to be a lawyer, you can even have a law student help you out. and how do i know all this, because i am represnting my brother who is faceing 6 felonys in 2 different counties and i have no legal experience, meaning i never went to school for it. so not everybody knows everything."

Sorry, I just need to make a few points of clarification (you all know me, I can't help it)

1) yes, there is such a thing as representing one's self, it is commonly referred to as being a "Pro Se" litigant/defendant... as I mentioned above. (aside... it is commonly said that an individual representing themselves has a fool for a client)

2) If you do what you describe (represent your brother) in the state of Ohio, it is considered the Unauthorized Practice of Law.

3) If a Law Student did what you are describing in the state of Ohio, they most likely would be precluding from taking the bar examination due to that conduct.

4) The plural for Felony is Felonies "i" not "y", and an individual charged with either the singular or the plural is generally entitled to (always in Ohio) court appointed counsel if they cannot afford private representation. May I recommend that your brother investigate that option... that is unless he has a desire to go to Prison.

Consider this the end of this discussion, sorry... I thought people in the slammer would spawn a more entertaining thread, not some discussion regarding a non-lawyers representation of another in a criminal matter that began to become semi-contentious.

Anyone doing anything cool for New Years? Possibly heading to the fiesta bowl to see Texas and the Bucks?

I imagine we are hanging around P-Burg cause the stork dropped off my baby boy right on his due date (Nov 30). He (Samuel Dean Bucher 7 lbs 7 oz, 20.25 in) and his mother are doing fantastic!

I may be heading to Miami for UC and Virginia Tech in the Orange Bowl, or I might hang with my Grandpa in N. Fort Myers, FL for New years still up in the air.! Class of 99 see ya in June. Happy Holiday's!!!

Zak I figuared you would have box seats ... all celebrities do! It appears that I'll have to settle for listening to the game on the radio in the frozen tundra of Ohio. Gotta love this workin thing they make us do when we grow up. Boooo work!

Well Andrew, I'm not in Ohio am I, no I'm in Texas and the laws are different down here. My brother has a court appointed attorney and he isn't worth shit. I have done more for him than the lawyer has. And in regards to a fool for a client, I supose that you would be a fool if you represented yourself as well. And I am not an incompatant person, I can help him and I am doing so. Just because I'm not a lawyer doesn't mean I don't know a thing or two about the law.

Soap Jackson,

I have been kind in this exchange and this tone has not changed, even as I have grown weary of your replies, so just do me one favor, understand this discussion is now over... enjoy court, do not tell us about it.

To everyone else, what is the best thing to do when a baby gets the hic-ups?

Zak I listen to the mid day heat every day at work. If I have to hear you say Latino heat, in that high pitch voice one more time I might kill myself. Just Kidding you do a good job.

Sixty dollars per couple, better be an open bar.

I am kind of hoping to see more battles of wit take place here. So Andy, Christine, Creationism, your thoughts? Glad everyone is doing well. Steve been a long time, what are you up to now?

I unfortunately won't be able to make it this year, too much going on, and already trying to go to Ireland for a honeymoon, or taking the kids to Disneyworld for a long weekend. It is kind of nice being 5 hours from Orlando, rather than 17 hours away.

Josh,
As the battle of wits was entertaining I must say this topic will be even more so..lol.. I will be sure to keep my opinions to myself ( I find I stay out of trouble that way LOL)

I am well. Cali is treating me wonderfully, the weather, the beaches, the palm trees, although I am getting tired of going to the gym all the time, but Its almost required here in SOCAL.;-)

How have you been? Hope GA is being kind to you. Hit me back with an update. let me know how life is going for you. Congrats on the marriage and family. Glad you are well!!

Steve and Josh you both are lucky cause I am sitting here looking out my window snow and it's still falling :-(

Wish I was in Cali right now...

I hear its awful back in Ohio. I feel for you all, I do not miss that one bit, especially living near cleveland the last few years. Eventually I may miss the snow but if that ever happens I'll drive 2 hours to Big Bear Mountain and hit the ski slopes. LOL. I have no intentions of living in it again, but if you ever need a place to vacation to get away from it let me know.

I like the winter time, but it's way too cold. Can't play outdoor hockey right now. Spring Training needs to get here soon. Hope everyone is signing up for the reunion, we are planning to make it a blast for everyone. Later on!

Damn global warming...I mean "climate change."

Due to the frigid temperatures these past few days in Tampa (highs of only 65), I have to wear a jacket and had to cancel beach plans for this weekend!

Zak - 5 weeks and counting until spring training.

Josh,

Creationism ehhh... well if you want to catch a good flick on the topic rent "Expelled" a documentary on the ID debate done very well by Ben Stein. For a documentary on much more serious matters that I HEAVILY recco... check out "King of Kong, a fist full of quarters" you will love it, I know your style.

Steph, the hicups still show up on a regular basis but he deals with em so we do too.

Steve, hearing that the Gym is mandatory for residents of SoCal makes the cold that much easier to handle here in the pseudo north pole... even knowing we got about 10in of the cold stuff this week.

Dan, yes, this global ?warming? is a bitch... we should have all listened to that prophet Al Gore.

Zak, I am skeptical of any party you are involved with that is not taking place at Sammy and Denise's (bless them) or in the Shed.

Finally if anyone is bored (or suffering from insomnia) check out

http://www.sconet.state.oh.us/videostream/archives/2009/

and click on Columbus Bar Asscn v American Family Prepaid Legal (Jan 13th), gets really good around the 12 min mark.

Steve I will definitely hold you to the vacation spot if this weather gets any worse...

01/19/09 05:07 PM #61

Zak Moore

Dan, Yep that "global warming" has really affected the midwest with all the below zero temps and endless amount of snow that I see everymorning during the week at five in the morning. It makes me feel good to know that my fingers could fall off if I'm outside longer than 10 or 15 minutes at a time. So much for pumping gas, thanks "global warming". Al Gore is loco.

Impressive Andy, glad to see you doing what you do and doing it so well.

Thanks Steve, I was pleased to get the opportunity to argue there, especially being such a young lawyer... and I actually really enjoyed it.

Alright kids....well I was going through here the other day and I got to thinking....I am a picture FANATIC.. and I saw not too many people posted in c/o 99 pics, so I went through some old boxes and check out what I found.. I posted some new pics to my profile, Sara, Heidi, Zak, Andy, Corrie, I could name some more but just check them out. Sure to bring a smile to some faces. There is even one from 7th grade, just for Corrie, Sara and Kristin. Let me know what you thought of them. I figured I'd represent 99 like I rememer them!!
