RULES AND REGULATIONS

THE VILLAGE AT APACHE WELLS

REVISED AND ADOPTED APRIL 6, 2021

 

This is a summary of the Rules and Regulations governing the actions of the board, owners, lessees (renters), and guests in The Village at Apache Wells. The Board of Directors has the authority to adopt and amend any reasonable rule and regulation concerning the use of the Condominium Property and to further clarify items in the CC&Rs and Bylaws.

It is the owners’ responsibility to ensure that they, their lessees (renters) and guests receive a copy and obey these Rules and Regulations. For the purposes herein, lessee and renter are considered to be one and the same. 

Advertising: It is prohibited to place advertisements or posters of any kind in or on the Condominium Property unless prior approval is obtained from the Community Association Manager (CAM).

Age Restriction: The Village at Apache Wells is a 55+ community. Each condo must be occupied by at least one person 55 years of age or older. No person under 18 years of age shall occupy a condo other than as a guest.  Guests who are under 18 may not stay in the VAW for more than 90 days in any 12 month period.

Architectural Uniformity:  No owner shall paint or otherwise decorate or change the appearance of any portion of the exterior of the building, including patio walls, sidewalks and driveways, without the prior written approval of the Board.

  • The colors used in the village for the condo walls (Navajo White), doors, trim, garages, railings, window frames and awnings are restricted by the association. No resident is allowed to use any color on the exterior of their condo other than the approved colors.Touch-up paint is available in the office for doors, garages and railings.
  • Owners must get pre-approval from the CAM to install new or replacement doors or windows.The doors and windows must match the community standards.

 

Balconies and Patios:

  • Should be kept clean of clutter or mess.
  • It is prohibited to hang towels, rugs, garments, for sale signs or other items from the railings or from any part of a condo’s exterior surface.
  • Bikes are not to be stored on balconies.
  • No items may be placed on the tops of the walls.
  • Note: Christmas decorations may be placed on railings and the tops of patio walls from December 1st to January 10th.

Bikes: Bikes are to be stored in the owner’s personal residence or in the racks provided in the parking lots or secured in the area behind the library, not in stairwells or on balconies. Keys to the secured area are available from the office.

Bird Feeders/Bird Baths, etc.: It is prohibited to attract wild birds to the condominium property by the use of bird feeders, bird baths or any other means whatsoever. This provision, however, does not apply to hummingbirds.

Clubhouse: The Clubhouse and its facilities are available to owners, lessees and guests who must adhere to the following rules:  

  • In order to reserve the clubhouse for a special event, an application must be made to the social committee chairperson or the CAM.The rules and requirements for private parties at the clubhouse and other required forms are available at the clubhouse.
  • If the facilities are used after hours, make sure the lights are turned off, doors locked.
  • Anyone under the age of 18 must be accompanied by an adult.
  • Shoes or footwear of any type must be worn. The torso must be covered by one or more items of clothing.
  • Note: The calendar of events in the clubhouse is kept by the CAM and hangs on the wall near the north door.Activity notices are on the west wall near the north door.

Common Elements: The Common Elements include everything in the Condominium project, except for the individual condominium units.  These common elements are owned by Association Members. Therefore, it is prohibited for any owner to make any changes or modifications whatsoever to the Common Elements.  The Common Elements include, but are not limited to, buildings, exterior lights, streets, sidewalks, driveways trees shrubs, stairwells, parking areas, swimming pools and spas.

Dusting Rugs: It is prohibited to dust (shake/beat) rugs from the windows or any part of a condominium’s exterior surface.

Fire Safety

  • Only electric grills may be used on balconies. Gas grills are permitted on Phase 4 patios and ground floor units when the grill is moved out from under the overhang.
  • Stairwells and landings must be free of furniture.
  • Please locate your nearest fire-extinguisher and verify that it is charged (in the green) at least monthly.

Garbage:  Containers around the Village are provided for household refuse only – no appliances, furniture, or demolition materials.   Subcontractors doing any remodeling should agree to take any debris with them.

Garage Sales: All garage sales, other than those sponsored by the Homeowner’s Association, must be approved by the CAM. Individual owner garage sales are limited to one a year.

Guests:  Guests are defined as “a person or persons residing with the owner or a lessee of a unit” rent free.  Guests are limited to the following:

  • Guests over 18 may not stay in a unit more than 30 days in a given year unless otherwise approved by the CAM. (BOD11-19-2002)
  • Guests under 18 may not stay in a unit more than 90 days in a given year unless otherwise approved by the CAM.
  • Any guest who plans to stay overnight or longer must register at the office.
  • A guest who occupies a unit without the presence of the owner must register at the office and provide the CAM with the length of their occupancy and verification of their age (55+) by government issued ID.

Landings: The immediate common exit area outside of each unit is considered a common element and must be kept clear of clutter. 

  • Bikes and patio furniture may not be placed or stored in the common landing area.
  • Owners must have pre-approval to modify the flooring (carpeting/tile) on any patio or balcony.

Leasing/Renting:  Leasing within the Village at Apache Wells is limited by the following restrictions:

  • No condo shall be leased or rented to anyone under the age of 55.
  • No condo shall be rented for an initial term of less than 30 days.
  • All leases shall be in writing.
  • Lessees must register at the office and provide the CAM with the commencement and termination dates of the lease and verification of their age (55+) with government issued identification.

Nuisances:  No nuisance (noise, odors, activities, or unsightly conditions) shall be permitted to exist upon the Condominium Property which may be or may become an annoyance or a detriment to other units or their occupants or owners. The Board, in its sole discretion, shall have the right to determine the existence of any nuisance.  VAW quiet hours are from 10pm until sunrise.

Parking & Repair: One covered parking space in phases I, II, and III is assigned to each unit owner.

  • Beyond the owner spot defined above, motor vehicles of any kind shall not be parked, stored, or repaired on the Condominium Property without prior approval of the Board.
  • No mobile home, motor home, boat trailer of any kind, commercial use truck, truck-camper, tent or similar structure shall be kept or placed on the Condominium Property, except for a 24-hour period to facilitate the loading and unloading of a condo.

Pets: No animals, fish or birds of any kind shall be raised, bred or in any way kept on the Condominium Property. Service dogs and emotional support animals must have the appropriate medical documentation which is to be updated annually.  Under no condition will more than one emotional support animal be approved for a unit.

Pools/Spas:  The hours and conditions for use are posted in the pool area.  Key rules from those signs include:

  1. All guests and renters must be registered in the office in order to use the pool.
  2. Short term (day) guests must be accompanied by the homeowner or registered lessee.
  3. Any person under the age of 18 must be accompanied by an adult.
  4. Gates to the pool area must be locked immediately upon entrance or exit.
  5. The chairs must be completely covered with toweling to prevent staining.
  6. No diving, jumping, running, or horseplay is allowed in or around the pool.
  7. Infants must wear waterproof diapers.
  8. No glass objects of any kind.
  9. Pool users should clean up their immediate area prior to leaving the pool area.

Roof Access:  Access to the roof of any unit by homeowners or contractors requires prior approval by the CAM.  Applicants must complete a request for roof access form available in the office.

Signs: No sign, other than a name and address sign not exceeding 9” x 30” in size, of any nature whatsoever shall be permitted on the Condominium Project.

Use of Condominium Property: There are three key rules governing the use of your personal condominium:

  • No part of the Condominium Property shall be used for business, professional, commercial, religious, institutional or other non-residential purposes.
  • Each Unit in the Condominium Property shall be known as, and limited to, a single family residential use.
  • A copy of the keys to your residence must be kept in the locked cabinet in the office.If you change your locks, please provide the CAM with a new set of your keys.

Windows: No reflective or unsightly material shall be placed in the windows or other surfaces of a unit which can be seen from the outside of the building.
